Minor alleges improper parking caused him to be struck by vehicle

BELLEVILLE — A minor child is suing Jackie Joyner-Kersee Foundation and a motorist after he was allegedly struck by another vehicle while trying to exit a poorly parked Foundation vehicle. 

Jaimarcus McDaniel, a minor by his grandmother and next friend Emogene McDaniel, filed a complaint on March 20 in the St. Clair County Circuit Court against Jackie Joyner-Kersee Foundation and Keshe Davison, alleging Jackie Foundation's employee improperly parked.

According to the complaint, the plaintiff alleges that on Oct. 6, 2017, he was being transported in a vehicle owned by Jackie Foundation and driven by its employee Asurian Williams, who improperly parked in the roadway. 

Due to the situation, the plaintiff claims he was forced to exit the vehicle in an unsafe manner, causing him to be struck by a vehicle driven by Davison. 

As a result, he received injuries to his neck, back and leg and incurred medical expenses in excess of $50,000. 

The plaintiff alleges Davison failed to keep careful lookout for pedestrians and failed to maintain proper control of her vehicle to avoid injuring the plaintiff.

The plaintiff requests a trial by jury and seeks judgement against the defendants in excess of $50,000.
