BELLEVILLE — A passenger is suing a motorist for allegedly causing a collision on North Illinois Street.
James Burke filed a complaint on March 14 in the St. Clair County Circuit Court against Jessica Butcher alleging she failed to maintain control of the vehicle she was driving.
According to the complaint, the plaintiff alleges that on Jan. 6, 2017, he was a passenger in a vehicle traveling north on North Illinois Street when the defendant struck the rear of the vehicle he was riding in.
As a result, Burke claims he suffered injuries to his neck, back and shoulder, suffered disability, and endured necessary medical care and treatment expenses.
The plaintiff alleges Butcher negligently drove her vehicle at a speed greater than reasonable, failed to keep proper lookout and failed to timely apply brakes to avoid a collision.
The plaintiff requests a trial by jury and seeks judgment against the defendant in a fair and just award exceeding $50,000, plus costs of court.
He is represented by Thomas C. Rich, Kristina D. Cooksey and Michelle M. Rich of Rich, Rich & Cooksey PC in Fairview Heights.
