Property buyer alleges sellers failed to disclose defects

EDWARDSVILLE — A Troy property buyer is suing the sellers for allegedly failing to disclose known material defects in the home. 

Aaron Harper filed a complaint on March 12 in the Madison County Circuit Court against Jared Jackson and Jennifer Chatham, alleging they violated the Residential Real Property Disclosure Act.

According to the complaint, the plaintiff alleges that on Aug. 12, 2017, he entered into a contract with the defendants to buy a residential property located at 702 South Main Street in Troy. However, he claims the defendants failed to disclose known material defects in the heating, air conditioning and/or ventilation systems. 

As a result, Harper claims he suffered damages for costs to replace and reconstruct the HVAC system and costs to prosecute this action. 

The plaintiff requests a trial by jury and seeks judgment against the defendants in excess of $50,000, plus attorney's fees and court costs.
