Fifth Third Bank claims Madison County residents defaulted on loan

EDWARDSVILLE — A bank is suing Madison County residents, citing alleged breach of contract.

Fifth Third Bank filed a complaint March 13 in the Madison County Circuit Court against Kimberly S. Franko and James A. Franko Jr., alleging they failed to perform their contractual obligations.

According to the complaint, the plaintiff alleges that on Aug. 15, 2016, the defendants entered into a loan agreement with the plaintiff's assignor, Home Equity of America Inc. The plaintiff claims the defendants are in default and owe $50,560.24. 

The plaintiff holds Kimberly Franko and James Franko Jr. responsible because they allegedly defaulted on the account by failing to make payments when due.

The plaintiff seeks a judgment against the defendants for $50,910.24, including attorney's fees of $350, plus costs of court. It is represented by Robert G. Markoff of Markoff Law LLC in Chicago.
