Suit alleges construction company failed to make payments

EDWARDSVILLE — A materials supplier is suing a contractor and the company's manager, citing alleged breach of a credit agreement and personal guaranty.

American Builders and Contractors Supply Co. Inc. filed a complaint March 9 in the Madison County Circuit Court against One Way Construction LLC and Eric Gleaton, alleging they failed to fulfill their contractual obligations.

According to the complaint, the plaintiff alleges that between April 27 and Aug. 30, it supplied construction materials to the defendants on a credit basis. After all proper credits for payments, the amount of $159,744.57 remains due and unpaid, the suit states. 

The plaintiff alleges the defendants failed to make payments on the amount due.

The plaintiff seeks a judgment against the defendants in the amount of $159,744.57, plus interest, attorney's fees and costs.
