Couple files suit against USAA Casualty Insurance over uninsured motorist coverage

EDWARDSVILLE – A couple is seeking damages from their insurer for uninsured motorist benefits to compensate them for injuries sustained in an accident.

Julia K. Holsman and Darol K. Holsman filed a complaint on March 7 in the Madison County Circuit Court against USAA Casualty Insurance Co., alleging breach of contract.

According to the complaint, the plaintiffs allege that on Oct. 21, 2014, they were in a vehicle traveling on U.S. Route 40 near its intersection with Spring Valley Road in Troy when an uninsured driver struck their vehicle. 

The plaintiffs claim they suffered numerous injuries that resulted in pain, suffering, loss of earnings and benefits and medical expenses. 

The suit states the plaintiffs and defendant went into arbitration regarding an award of damages under their uninsured motorist coverage portion of their policy with the defendant. However, the plaintiffs rejected the arbitration award on March 6.

The plaintiffs allege USAA Casualty Insurance breached its policy with the plaintiffs by failing to pay them compensatory damages to which they are entitled.

The plaintiffs request a trial by jury and seek judgment against the defendant in a sum of more than $50,000, plus costs of suit.
