Suit alleges intoxicated motorist caused fatal Highland crash

EDWARDSVILLE – A man alleges a Collinsville motorist was under the influence of drugs or alcohol when he caused a fatal collision in Highland. 

Blake Baum, special administrator of the estate of Charlene Johnson, filed a complaint on March 5 in the Madison County Circuit Court against Wayne Stayton, alleging wrongful death.

According to the complaint, the plaintiff alleges that on Feb. 23, the defendant was traveling eastbound on U.S. 40 in Highland when he crossed the center line and struck Johnson's vehicle. The suit states Johnson later died as a result of injuries sustained in the collision.

The plaintiff alleges Stayton was driving under the influence of ingested drugs and/or alcohol, failed to keep a proper lookout and failed to reduce or decrease his speed to avoid a collision.

The plaintiff seeks judgment against the defendant in an amount of more than $50,000, plus costs and all other relief that is just and appropriate.
