Missouri driver seeks damages from Belleville woman over collision

EDWARDSVILLE – A Missouri man alleges a Belleville woman was distracted by her cellphone and under the influence when she caused a collision.

David Donald filed a complaint on Feb. 28 in the Madison County Circuit Court against Heather Sherman, alleging negligence.

According to the complaint, on March 12, 2016, the plaintiff alleges Sherman carelessly caused a collision while using her cell phone. 

Donald claims he sustained serious and permanent injuries to his lower extremities, neck, low back, knees, shoulders and head and suffered lost wages and medical expenses. 

The plaintiff alleges Sherman negligently used her cellphone while driving, was drinking alcohol before or while driving, failed to maintain a careful lookout and failed to reduce speed or stop to avoid a collision.

The plaintiff seeks damages in excess of the court's minimum threshold and such other relief that is fair and reasonable.
