Motorist alleges brain injury from Troy collision

EDWARDSVILLE — A motorist claims she suffered brain injury in a Troy collision. 

Amanda A. Mason filed a complaint on March 2 in the Madison County Circuit Court against Stanley A. Penn, alleging he breached his duty to exercise ordinary care for the safety of others.

According to the complaint, the plaintiff alleges that on Sept. 5, 2017, she was driving a 2008 Nissan Maxima on US Highway 40 near its intersection with Creekside Road in Troy when the defendant caused his pickup truck to strike the rear of her vehicle. 

Mason claims she suffered closed head brain injury, pain and suffering, past and future lost wages and medical expenses. 

The plaintiff alleges Penn negligently drove his vehicle too fast for the existing condition, failed to keep proper lookout and failed to use evasive actions to avoid a collision.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount exceeding $50,000, plus costs.
