BELLEVILLE – A customer at an O'Fallon La-Z-Boy store alleges a gap in the parking lot concrete caused her to fall.

Patricia A. Hendricks filed a complaint on Feb. 13 in the St. Clair County Circuit Court against La-Z-Boy Inc. and AEI National Income Property Fund VII LP, alleging negligence.

According to the complaint, the plaintiff alleges that on Feb 20, 2016, she was walking toward the entrance of the defendants' store in O'Fallon when she tripped on a gap between the asphalt and concrete in the parking lot, causing her to stumble.

Hendricks claims she suffered severe, permanent and disabling injuries to her right knee and body as a whole as a result.

The plaintiff alleges the defendants failed to inspect the parking lot to make sure it was safe for its customers and failed to abide by codes regarding parking lots and handicapped spaces.

The plaintiff requests a trial by jury and seeks damages of more than $50,000 but less than $75,000, plus costs of this action.

She is represented by Joseph A. Bartholomew and Leah A. Captain of Cook, Bartholomew, Shevlin & Cook LLP in Belleville.
