Widow sues motorist, State Farm following husband's fatal collision

Insurance 05

BELLEVILLE — The surviving spouse of a motorist alleges another driver caused a fatal collision by stopping suddenly without warning.

Patricia Johnson filed a complaint on Feb. 6 in the St. Clair County Circuit Court against State Farm Mutual Automobile Insurance Co. and Milton Crowder, alleging Crowder failed to exercise due care in operating his motor vehicle.

According to the complaint, the plaintiff alleges that on June 2, 2017, her husband Milton Johnson was driving his motor vehicle behind Crowder when the defendant suddenly stopped without warning, causing Milton Johnson to rear end his vehicle. Milton Johnson sustained fatal injuries and died on June 15, 2017.

Prior to decedent's death, All State confirmed that the insurance on his behalf was in full force.

The plaintiff alleges State Farm failed and refused to settle the plaintiff's uninsured motorist claim stemming from the death of her husband.

The plaintiff requests a trial by jury and seeks damages for the wrongful death of her husband, plus attorney's fees, costs and any further relief as the court deems equitable.

She is represented by Nuru Witherspoon of The Witherspoon Law Group in Chicago.
