Driver allegedly struck disabled vehicle, causing fatal collision

EDWARDSVILLE — A special administrator is suing an Oregon corporation and its employee for allegedly causing a fatal collision.

Jo Lair, as special administrator for the estate of Jon L. Lair, filed a complaint on Jan. 31 in the Madison County Circuit Court against Santiago Reyes and Combined Transport Inc., alleging Reyes failed to maintain proper control of the vehicle owned by his employer, Combined.

According to the complaint, the plaintiff alleges that on Dec. 2, 2016, decedent Jon Lair's pickup became disabled in the eastbound lanes of Highway 64. She alleges Reyes negligently attempted to pass a tractor-trailer and collided with the decedents vehicle, thereby causing his death. 

As a result, the plaintiff claims she suffered pecuniary losses, including but not limited to loss of love, society and affection of decedent. 

The plaintiff alleges Reyes failed to maintain careful lookout and failed to take evasive actions at the first appearance of danger.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount greater than $50,000, plus all further relief the court may deem just and proper.
