Motorist sues over Alton collision

Car accident 09

EDWARDSVILLE – A woman is seeking damages from an Edwardsville man and his employer after a collision in Alton.

Erika Jakich filed a complaint on Feb. 1 in the Madison County Circuit Court against Mark Bausch, S.M. Lawn & Landscape Inc. and Sean McElligott, alleging negligence.

According to the complaint, the plaintiff alleges that on March 7, 2016, she was operating a 2001 Ford Expedition traveling southbound on Landmarks Boulevard in Alton when Bausch, who was driving a 2011 Ford owned by S.M. Lawn and McElligott, negligently operated the vehicle and caused it to collide with the plaintiff's vehicle.

As a result, she claims she sustained severe and permanent injuries that resulted in pain, mental anguish, lost wages and medical expenses.

The plaintiff alleges Bausch failed to see and observe other vehicles on the road and failed to maintain speed that was proper under the circumstances.

The plaintiff requests a trial by jury and seeks judgment against each defendant in an amount of more than $50,000, plus costs of this action.

She is represented by Patrick G. Johnston of Johnston Law Offices PC in Edwardsville.
