BENTON – A Pomona limited liability company alleges it is entitled to certain coverage under an insurance policy for fire damages at the property.
Abbey Ridge LLC filed a complaint on Jan. 16 in the U.S. District Court for the Southern District of Illinois against Addison Insurance Co. seeking declaratory judgment.
According to the complaint, the plaintiff alleges that on Feb. 1, 2017, a fire occurred at the plaintiff's insured property in Pomona, causing extensive damage to the real and personal property. The plaintiff alleges it submitted a claim against the defendant under the policy for the loss.
The suit states that on or about May 16, 2017, through its public adjuster, the plaintiff requested coverage for the damages to the new building under the newly acquired or constructed property provisions of the defendant's policy, which was denied.
The suit states a dispute has arisen between the two parties regarding the coverage under the policy.
The plaintiff seeks an order declaring it is entitled to coverage under the newly acquired or constructed property provision, damages in an amount of more than $460,948.07, plus interest, costs and all other relief that the court deems just and proper.
