Woman seeks to recover benefits she alleges were wrongfully terminated

BENTON – A Monroe County woman alleges her long-term benefits were wrongfully terminated.

Michelle Fink filed a complaint on Jan. 23 in the U.S. District Court for the Southern District of Illinois against Solutia Inc. Disability Income Plan and Reliance Standard Life Insurance Co., alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff became disabled and filed for long-term disability benefits under the Solutia plan and was approved in September 2012. The suit states her benefits were terminated in March 2013 on allegations that she was no longer eligible.

The plaintiff alleges the defendants failed to take her medical records into consideration and that she was awarded Social Security benefits.

The plaintiff requests a trial by jury and seeks to recover disability income benefits, attorney’s fees, costs and expenses and any further relief as the court deems just and appropriate.
