Son files negligence suit against Buffalo Pumps Inc., others over father's cancer-related death

BELLEVILLE – A man alleges his late father's lung cancer was caused by asbestos exposure during his career from 1971 to 1990.

Fernando Green, individually and as special representative of the estate of Leon Fudge, deceased filed a complaint on Jan. 23 in the St. Clair County Circuit Court against Buffalo Pumps Inc., Howden North America Inc., Trane US Inc., et al. alleging negligence.

According to the complaint, the plaintiff alleges that at various times during Fudge's career, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. The suit states that on or about July 26, 2017, decedent first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. He died on Aug. 27, 2017, the suit states. 

The plaintiff holds Buffalo Pumps Inc., Howden North America Inc., Trane US Inc., and others responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew that it had toxic, poisonous and deleterious effect to human's health and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory damages of more than $50,000, plus punitive damages, and all other and further relief that the court may find appropriate. He is represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
