Motorist sued over O'Fallon rear-end collision

BELLEVILLE — A motorist is suing another driver for allegedly rear-ending him and causing a multi-car collision in O'Fallon. 

James Flanigan filed a complaint on Jan. 18 in the St. Clair County Circuit Court against Garey Zimmer, alleging he failed to maintain proper control of his vehicle.

According to the complaint, the plaintiff alleges that on Feb. 19, 2016, he was driving a motor vehicle east on Highway 50 in O'Fallon. He claims he was stopped behind another vehicle when Zimmer rear-ended him, thereby causing a chain of collision. 

As a result, Flanigan claims he sustained severe and permanent injuries to his head, neck, shoulders, spine and back. 

The plaintiff alleges Zimmer failed to keep proper lookout, failed to yield right of way and failed to reduce speed to avoid collision.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs.
