Mitchell Elementary School student allegedly assaulted when teacher left classroom

EDWARDSVILLE – The mother of a Mitchell Elementary School student alleges her daughter was assaulted by another student and injured when a teacher left the classroom.

Miranda Malmkar, as mother of J.C.M., a minor filed a complaint on Jan. 22 in the Madison County Circuit Court against Granite City Community Unit School District No. 9, Mitchell Elementary School Principal Lisa Yarbrough and teacher Tiffany Kahn alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 25, 2017, her minor daughter J.C.M. was assaulted by a fellow student when Kahn left the classroom unattended. The suit states J.C.M. sustained injuries all over her body, including but not limited to her lower spine.

The plaintiff holds Granite City Community Unit School District No. 9, Yarbrough and Kahn responsible because Kahn allegedly negligently left the classroom unattended when she knew that leaving a classroom of students posed serious risk of harm to the students.

The plaintiff seeks judgment against defendants of more than $50,000, plus costs of this suit. She is represented by Thomas E. Hildebrand of Thomas E. Hildebrand Law Office in Granite City.
