Former hospital shuttle service employee sues over unpaid vacation time in class action

EDWARDSVILLE – A Madison County woman alleges her former employers failed to compensate her for unused vacation time and time she spent working on-call.

Donna Warnecke, individually and on behalf of all others similarly situated, filed a complaint on Jan. 24 in the Madison County Circuit Court against Carrco LLC, Hospital Shuttle Services Inc., et al., alleging they violated the Illinois Wage Payment Collection Act.

According to the complaint, the plaintiff alleges that between March 7, 2015, and March 14, 2017, she was employed by the defendants. At the time of her termination, she alleges she had accrued approximately 80 hours of unused vacation time and that the defendants have failed and refused to compensate her for her time. She also alleges she was not paid for time she spent working on-call.

The plaintiff requests a trial by jury and seeks all damages in an amount believed to be of more than $50,000, reasonable attorney's fees, costs and any further relief that the court may deem just and appropriate.
