Property owners allege Resource Construction installed defective flooring

EDWARDSVILLE – The owners of a St. Jacob property allege flooring installed by a Madison County company is defective.

Mark Brown and Julie Brown filed a complaint on Jan. 10 in the Madison County Circuit Court against Resource Construction Co. LLC, alleging breach of contract, negligence and breach of implied warranty of habitability.

According to the complaint, the plaintiffs allege that on July 22, 2015, they requested Resource Construction to replace the flooring on their property. The plaintiffs reported their concerns about defects in the flooring to the defendant in October 2015, but Resource Construction failed to correct the issue. 

A later inspection in January 2016 found the floor was defective because of installation issues, the suit states.

The plaintiffs allege that the cost to remove and replace the flooring will be more than $30,000.

The plaintiffs allege the defendant failed to properly acclimate and install the flooring and failed to install the flooring in a good and workmanlike manner.

The plaintiffs seek actual damages of more than $50,000, plus further relief the court deems just and proper.
