BELLEVILLE– An East St. Louis grocery store is seeking judgment in a dispute with its insurer for a theft coverage claim.
Heroes Market II Inc. filed a complaint on Dec. 15 in the St. Clair County Circuit Court against Certain Underwriters at Lloyds, London, Syndicate 609, seeking declaratory judgment.
According to the complaint, the plaintiff alleges that on Nov. 14, a back door break-in occurred at the plaintiff's store, causing property damage and the theft of more than $24,000 worth of stock inventory. The plaintiff asserts coverage for theft property damage under the insurance policy issued by the defendant in the amount of $22,017.37.
The suit states the defendant disputes and denies coverage for 90 percent of the plaintiff's claimed loss and has failed and refused to pay indemnity to the plaintiff for the loss.
The plaintiff seeks an order requiring the defendant to indemnify the plaintiff's theft property damage loss, prejudgment interest, attorney's fees, costs, and all other and further declaratory relief.
