BELLEVILLE – A driver is seeking damages from multiple defendants over two unrelated collisions in 2016.
Marshall Flynn filed a complaint on Jan. 2 in the St. Clair County Circuit Court against Deseree Jakubecz, Rick Pierce, Nathan Lee and McDaniel Funeral Homes LTD, alleging negligence.
According to the complaint, the plaintiff alleges that on Jan. 22, 2016, he was driving on Central Park Drive in O'Fallon when he was struck by Jakubecz. Then on Feb. 12, 2016, the plaintiff was involved in another collision with Pierce in Belleville, who was driving a vehicle owned by Lee and McDaniel Funeral Homes. Flynn alleges the second collision aggravated the injuries he sustained in the previous accident.
The plaintiff alleges he sustained severe injuries to various parts of his body that caused him to suffer pain and suffering, medical expenses, loss of income, disability and disfigurement as a result of the separate collisions.
The plaintiff alleges Jakubecz and Pierce failed to keep a proper lookout and failed to be attention while driving.
The plaintiff seeks judgment against each defendant for actual damages of more than $50,000, plus costs of this action.
