Woman alleges lawsuit against Bayer was dismissed because Texas firm failed to respond to motion

BELLEVILLE – An Arkansas woman alleges a Texas lawyer failed to respond to a motion to dismiss, causing the dismissal of her suit.

Vernita Crowder filed a complaint on Jan. 9 in the St. Clair County Circuit Court against J. Robert Black and Robins Cloud PC, alleging legal malpractice.

According to the complaint, the plaintiff was represented by the defendants in her lawsuit against Bayer Healthcare Pharmaceuticals Inc. regarding alleged injuries she sustained from taking Bayer's Yaz prescription medication. The suit states her complaint was consolidated in multidistrict litigation in the Southern District of Illinois.

The plaintiff alleges the defendants failed to file any response to Bayer's motion to dismiss her claim and as a result, her claim was dismissed with prejudice in January 2016.

The plaintiff seeks judgment against the defendants, jointly and severally, for damages in an amount to be determined, plus interest, costs, expenses and all further relief as the court deems appropriate.
