Man sues MetroLink over 2017 shooting at Emerson Park station

Car accident 30

BELLEVILLE – An East St. Louis man is seeking damages after he was shot at a MetroLink station in early 2017.

Marques Phillips filed a complaint on Jan. 8 in the St. Clair County Circuit Court against Bi-State Development Agency of the Missouri Illinois Metropolitan District, alleging negligence.

According to the complaint, the plaintiff alleges that on Jan 23,2017, he was getting off the defendant's light rail car at around 10 p.m. and was attempting to take the only exit ramp at Emerson Park station when he was prevented from leaving.

He claims he was stopped by a number of “roughyins” who would not allow him to pass.

“As certain roughyins then took off away from the scrum which they previously created, a shot rang out and struck Plaintiff in the stomach,” the complaint states.

The plaintiff alleges that despite a previous shooting incident at the same station in November 2016, the defendant failed to provide sufficient security in the area.

The plaintiff seeks judgment against the defendant in an amount of more than $50,000, plus costs of this action and all other relief that the court may deem just and proper.

He is represented by Steven S. Fluhr of Fluhr & Moore LLC in St. Louis.
