Sun Life Assurance alleged to have wrongfully denied disability benefits

EAST ST. LOUIS – A Macoupin County woman alleges her claim for disability benefits was wrongfully denied.

Tamela Milkovich filed a complaint on Dec. 27, 2017, in the U.S. District Court for the Southern District of Illinois against Sun Life Assurance Co. of Canada, alleging the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, Milkovich alleges that on Aug. 6, 2016, she ceased working due to multiple sclerosis. She claims she applied for disability benefits under the defendant's plan, but her request was denied.

The plaintiff alleges Sun Life Assurance wrongfully determined that she did not meet the definition of disabled and denied her application for disability benefits.

The plaintiff seeks damages in an amount equal to the amount of benefits to which she is entitled, reinstatement to her group life insurance under waiver of premium provisions, attorney's fees and costs of this action. 

She is represented by David Hicks in Maryville.
