EAST ST. LOUIS – Several labor union funds allege they are owed nearly $20,000 for employee contributions from a company.
Painters District Council 58 401(k) Trust Fund, et al. filed a complaint on Dec. 28 in the East St. Louis Division of the U.S. District Court for the Southern District of Illinois against Quality Assured Industrial Coatings LLC, alleging violation of Employee Retirement Income Security Act and the Labor Management Relations Act.
According to the complaint, the plaintiffs allege that pursuant to the collective bargaining agreement with the defendant, they conducted an audit of the defendant's payroll for the period of January 2010 to October 2015. The plaintiffs allege the audit showed contributions owed in the amount of $28,192.45. After factoring in payments received, the amount of $19,820.27 allegedly remains due and owing.
The plaintiffs seek judgment against the defendant in the amount of $19,820.27, plus attorneys’ fees, costs and any other relief that is just and equitable.
