Keeley & Sons claims Ohio company failed to make payments on settlement agreement

BELLEVILLE – An East St. Louis full-service contractor alleges an Ohio structural steel fabricator and material supplier failed to make payments as required by a settlement agreement.

Keeley & Sons Inc. filed a complaint on Dec. 12 in the St. Clair County Circuit Court against Created by Dina Inc., doing business as CBD Fabrication and Supply Inc.; CBD Fabrications Inc.; and Dina M. Colombo-Gay, alleging breach of contract.

According to the complaint, the plaintiff filed a complaint against the defendants over breach of contract allegations in September 2016 and the parties later entered into a settlement agreement. The plaintiff alleges the defendants agreed to pay it $172,850, plus interest.

The plaintiff alleges the defendants failed to make monthly payments as required by the settlement from September to December despite repeated demands.

The plaintiff seeks payment of the remaining balance of $166,924.60 plus interest, award of general compensatory damages, attorneys' fees, costs, expenses and such other and all relief may be deemed appropriate.
