BELLEVILLE – A festival attendee at a Fairview Heights park alleges he was injured after tripping on an electrical box.
William C. Carter filed a complaint on Nov. 20 in the St. Clair County Circuit Court against the City of Fairview Heights, alleging negligence.
According to the complaint, the plaintiff alleges that on Aug. 11, he was an invited guest at the homecoming at Moody Park in Fairview Heights. While there, he claims he caught his foot and stumbled over one of the concrete electrical box lids that were in the area for the purpose of upgrading and improving the park.
As a result, Carter claims the fall caused him to fracture his humorous and injure his shoulder.
The plaintiff alleges the defendant failed to warn the guests of the park about the elevation of the electrical box and/or paint it with a color that would be recognizable by people using the park.
The plaintiff seeks judgment in an amount of more than $50,000.
