Alton and Southern Railway alleges CSX owes it more than $4M

BENTON – An East St. Louis railroad company alleges CSX Transportation failed to pay for holding charges.

The Alton and Southern Railway Co. filed a complaint on Nov. 16 in the U.S. District Court for the Southern District of Illinois against CSX Transportation Inc., alleging breach of contract and other counts.

According to the complaint, the plaintiff and defendant entered into an agreement in 1997 where the defendant agreed to pay certain charges related to blocking and holding services rendered by the plaintiff. The suit states that the plaintiff notified the defendant of termination of the agreement in January 2014.

The plaintiff alleges CSX failed to pay holding charges.

The plaintiff seeks judgment against the defendant in the amount of $4.36 million, plus additional holding charges, accrued interest, costs, attorney fees and all other relief as the court deems just and proper.
