Madison County farmer alleges hail damage claim was partially denied

Insurance 04

EDWARDSVILLE – A Madison County farmer alleges hail damage to his property was not fully covered by his insurance policy.

Kent Bohnenstiehl, doing business as Bohnenstiehl Farms, filed a complaint on Nov. 15 in the Madison County Circuit Court against Chris Straub, JW Insurance Group LLC and Heartland Mutual Insurance Agency Inc., alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Feb. 28, a hail storm struck his property and damaged many of his buildings. He alleges that before the storm struck, he contacted Straub, an insurance agent, to confirm that his insurance policy covered damages from wind and hail and was told that it did.

The suit states the plaintiff provided notice of the loss and property damage, which was denied in part by the defendants.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages of no less than $125,466.20, plus interest and any further just and appropriate relief.

He is represented by Mark B. Weinheimer of Weinheimer Law Firm PC in Edwardsville.
