Trustees of Central Laborers' Pension, Welfare & Annuity Funds seek more than $13,000 from employer

BENTON – A Vienna business is alleged to owe more than $13,000 to labor union funds.

Trustees of Central Laborers' Pension, Welfare & Annuity Funds filed a complaint on Oct. 10 in the U.S. District Court for the Southern District of Illinois against Jaime Ruiz, individually and doing business as and J R Construction, and J. Ruiz Construction alleging violation of the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiff alleges that the defendants are indebted to the plaintiff's health and welfare benefits funds in the amount of $10,308.88 for delinquent contributions, $2,349.49 for liquidated damages and $1,035 for audit costs. 

The plaintiff holds the defendants responsible because the defendants allegedly failed and refused to submit timely and accurate contributions to the employees' funds.

The plaintiff seeks an order requiring defendant to comply with an up-to-date audit of its books, award for damages in the amount of $13,693.37, attorney fees, costs and such other and further relief as the court may deem just and equitable.
