EAST ST. LOUIS – A Millstadt business is alleged to have failed to pay contributions to a labor union fund.
Trustees of the Local 309 Electrical Health and Welfare Fund, et al. filed a complaint on Oct. 23 in the U.S. District Court for the Southern District of Illinois East St. Louis against ITS Solar LLC alleging that the employer violated the Employee Retirement Income Security Act and the Labor Management Relations Act.
According to the complaint, the plaintiffs allege that the defendant filed reports in July and August but failed to pay contributions to the fund. They also allege that the defendant failed to file reports or pay contributions from September to the present.
The plaintiffs seek payment of the unpaid and delinquent contributions owed to the plaintiffs for the months of July 2017 to present, liquidated damages, attorneys’ fees and costs and such further relief as the court deems just and equitable.
