Former mechanic/driver names Advance Auto Parts Inc., others in suit alleging asbestos injuries

Asbestos 06

BELLEVILLE – A former mechanic/driver alleges asbestos exposure caused cancer.

Terry Boutin filed a complaint on Oct. 27 in the St. Clair County Circuit Court against Advance Auto Parts Inc., Bridgestone/Firestone Inc., Caterpillar Inc. alleging negligence.

According to the complaint, the plaintiff alleges that during his work from 1973 to 2014, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. As a result, he alleges he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused.

The plaintiff holds Advance Auto Parts Inc., Bridgestone/Firestone Inc., Caterpillar Inc., and others responsible because the defendants allegedly intentionally included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory damages of more than $50,000, punitive damages and all further relief that the court may deem appropriate. He is represented by Carson C. Menges of Menges Law LLC in Belleville.
