Consumer accuses Pekin Insurance Co. of fraud over denial of hail damage claim

EDWARDSVILLE – A Caseyville man alleges his auto insurer denied his claim for hail damages and wrongfully accused him of making fraudulent statements.

Ward Elkins filed a complaint on Oct. 27 in the Madison County Circuit Court against Pekin Insurance Co. alleging breach of contract and consumer fraud.

According to the complaint, the plaintiff alleges that on Feb. 28, his motor vehicle sustained damages due to a severe hailstorm while parked at a travel center in Troy. He alleges he reported his claim for hail damage to his vehicle under the policy issued by defendant. 

Despite providing proofs and documents to support his claim, the suit states the defendant denied his claim in July on the allegations that the plaintiff made fraudulent statements. The plaintiff alleges this is not true and that this assertion was made to deny a fair adjudication and payment of the plaintiff's claim.

The plaintiff seeks damages in an amount of more than $50,000, plus interest and costs. 

He is represented by Greg Roosevelt of Roosevelt Law Office in Edwardsville.
