State Farm accused of failing to pay underinsured motorist benefits

BELLEVILLE — An insurance policyholder is suing State Farm for allegedly failing to pay underinsured benefits. 

Lester Brian Downing filed a complaint Sept. 11 in the St. Clair County Circuit Court against State Farm Mutual Automobile Insurance Co., alleging the property insurer failed to effectuate a prompt and equitable settlement.

According to the complaint, the plaintiff alleges that on Jan. 7, 2016, he sustained severe injuries and damages after being struck by a vehicle driven by David Sickmier, an underinsured motorist. Downing claims he repeatedly requested benefits due under the insurance policy issued by State Farm but has yet to receive payments. 

The plaintiff alleges State Farm failed and refused to pay the amounts due under the policy.

The plaintiff seeks judgment in his favor in excess of $50,000 and costs for this action. 

He is represented by Clay B. St. Clair of Crowder & Scoggins Ltd. in Columbia.
