BELLEVILLE — A patient claims the da Vinci robotic device caused numerous injuries during surgery for endometriosis.

Melissa Griswold filed a complaint Oct. 18 in the St. Clair County Circuit Court against Intuitive Surgical Inc.; Blessing Corporate Services Inc., doing business as Blessing Physician Services; and Dr. Mark Hensley, alleging they failed to use due care in promoting the da Vinci robotic device as safer than other comparable methods of surgery.

According to the complaint, the plaintiff was diagnosed with endometriosis and alleges the defendants caused ureteral injury during surgery. As a result, she claims she required extensive procedures, including the removal of her right kidney.

She claims she has suffered a perforated and cut right ureter, neuropathic bladder, diminished urinary sensation and bladder and kidney spasms and has incurred substantial medical expenses.

Griswold alleges the defendants failed to provide adequate warning that the da Vinci robotic device can cause damage to the bowel, blood vessels, arteries, ureters and bladder.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, plus interest, costs of this action and any further relief that the court may deem appropriate.

She is represented by John S. Wallach and Bruce J. Weingart of Law Office of John S. Wallach PC in St. Louis.
