Man seeks disability benefits from insurer following spinal injury

BELLEVILLE – A former railroad worker alleges his claim for disability benefits have been denied after he suffered a spinal injury, leaving him disabled. 

Doug LeGrand filed a complaint on Sept. 15 in the St. Clair County Circuit Court against The Lincoln National Life Insurance Co., alleging breach of contract.

According to the complaint, the plaintiff alleges that while he was insured under the short-term and long-term disability policies issued by the defendant, he suffered a serious spinal injury and is now unable to perform his job duties. He alleges the defendant has failed to pay the benefits he is entitled to receive.

The plaintiff alleges the defendant refused to honor his claim and failed to pay his benefits. He also alleges it wrongfully contends that the plaintiff's Federal Employer's Liability Act settlement may be offset under the policies.

The plaintiff seeks damages in the full amount of disability benefits due to him, attorney's fees, costs, expenses and all other remedies that are lawful and equitable.
