Tractor-trailer driver seeks damages after Columbia collision

BELLEVILLE – A Red Bud tractor-trailer driver is seeking damages from a Cahokia man he alleges caused a collision.

Mark Neary filed a complaint on Aug. 21 in the St. Clair County Circuit Court against Jerry Stults alleging negligence.

According to the complaint, Neary alleges that on Sept. 30, 2015, he was driving northbound on Route 3 at South Main Street in Columbia when his Freightliner tractor-trailer was struck by defendant Stults, causing plaintiff to strike a third vehicle. As a result, Neary claims he suffered physical injuries, experienced pain and suffering and expended money for necessary medical services and treatment. 

The plaintiff holds Stults responsible because the defendant allegedly failed to keep a proper lookout for other vehicles, failed keep vehicle under proper control and failed to yield the right of way.

The plaintiff seeks judgment in an amount of more than $50,000, plus costs of suit and any other relief deemed just and proper. He is represented by Kirk A. Caponi of Williams, Caponi & Associates PC in Belleville.
