BELLEVILLE – Three corporations and a limited liability company allege that they were not paid for the sales of vehicle service contracts.
Marathon Administrative Co. Inc., Sparta Capital Management LLC, Consumer Services of Florida Inc. and Athens Administrative LLC filed a complaint on Sept. 8 in the St. Clair County Circuit Court against Gary D. Primm Jr. and United Auto Defense LLC, alleging breach of contract, breach of personal guaranty and unjust enrichment.
According to the complaint, the parties had agreements that required the defendants to timely remit payments received from the sale of vehicle service contracts. The plaintiffs allege the defendants have failed to remit the payments.
The plaintiffs allege that they have suffered damages from the loss of sale of the vehicle service contracts in the total amount of $1,123,222.01.
The plaintiffs request a trial by jury and seek actual damages, pre- and post-judgment interest, attorney's fees, costs and any other relief that the court may deem just and proper.
