Woman alleges motorist failed to yield right of way

Car accident 09

EDWARDSVILLE — A motorist is suing another driver for allegedly causing a collision after failing to yield the right of way.

Tara Fox filed a complaint on Aug. 28 in the Madison County Circuit Court against Jessica Barnard, alleging she failed to operate her vehicle with reasonable care and caution.

According to the complaint, the plaintiff alleges that on Aug. 5, Barnard failed to yield the right of way and caused a collision.

As a result, Fox claims he sustained temporary and permanent injuries, has incurred medical expenses and was prevented from attending his usual duties and affairs.

The plaintiff alleges Barnard drove her vehicle at a speed greater than reasonable and failed to maintain careful lookout.

The plaintiff requests a trial by jury and seeks judgment against defendant in excess of $50,000, plus costs of suit.

He is represented by Lanny Darr of Darr Law Offices Ltd. in Alton and Shawn K. Lintz of Lintz Law Firm in Alton.
