BELLEVILLE – A man alleges that his decedent suffered injuries while at the Virgil Calvert Nursing and Rehabilitation Center in East St. Louis.
J. B. Wagner, individually and as special representative of the estate of Genola Wagner, filed a complaint on Aug. 18 in the St. Clair County Circuit Court against Virgil Calvert Nursing and Rehabilitation Center Inc., Virgil Calvert Property LLC and SW Management Co., alleging that they violated the Nursing Home Care Act.
According to the complaint, the plaintiff alleges that during Genola Wagner's residency at the defendant's facility in June 2006, she sustained injuries to her arm, shoulder and nerves resulting in physical and mental pain, emotional distress and disability.
The plaintiff alleges the defendants failed to provide necessary care, treatment and services to prevent her from falling from her bed.
The plaintiff seeks damages of more than $50,000, plus attorney's fees and costs of the suit.
