Man alleges Arvinmeritor Inc., others' negligence caused asbestos-related cancer

BELLEVILLE – A laborer alleges exposure to asbestos during his career caused him to develop lung cancer.

Charles Ray Linders filed a complaint on Aug. 16 in the St. Clair County Circuit Court against Arvinmeritor Inc., A.W. Chesterton Co., Borg-Warner Corp., et al. alleging negligence.

According to the complaint, the plaintiff alleges that between 1972 and 1993, during the course of his employment and military service, during non-occupational work projects and/or in other ways, he was exposed to and inhaled asbestos fibers emanating from certain products that were manufactured, sold, distributed or installed by the defendants. The suit states that the plaintiff first became aware that he had developed lung cancer on Dec. 22, 2015. 

The plaintiff holds the defendants responsible because the defendants allegedly included asbestos fibers in their products when adequate substitutes were readily available and failed to provide adequate warnings and instructions on how to safely work with asbestos-containing products.

The plaintiff requests a trial by jury and seeks to award compensatory damages of more than $50,000,costs incurred prosecuting this matter, and to grant such other and further relief as the court deems appropriate.
