BENTON – A consumer claims a retail electricity company has contacted him with unwanted telemarketing calls in a proposed class action.

Allen Kreke filed a complaint, individually and on behalf of all others similarly situated, on July 28 in the U.S. District Court for the Southern District of Illinois against Liberty Power Holdings LLC, alleging it willfully violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff received a telemarketing call from the defendant on May 15 despite being registered on the National Do-Not-Call registry.

The plaintiff alleges Liberty Power Holdings made calls to his cellular telephone using an autodialer and artificial or prerecorded voice without plaintiff's prior express consent.

The plaintiff requests a trial by jury and seeks an order certifying this complaint as a class action and appointing plaintiff as class representative her counsel as class counsel.

He is represented by Anthony G. Simon and Anthony R. Friedman of The Simon Law Firm PC in St. Louis.
