John Beal Incorporated seeks payment from homeowner for roofing work

Late 06

EDWARDSVILLE — A roofing contractor is suing a property owner, alleging breach of contract for not paying a balance due.

John Beal Incorporated filed a complaint on June 26 in Madison County Circuit Court against Charles D. Williams, alleging he violated the terms of their written agreement by refusing to make payments.

According to the complaint, the plaintiff alleges that on March 21, it entered into an agreement with the defendant to replace a shingled roof, gutters and downspouts, and furnish ancillary materials at the defendant's property.

The defendant allegedly agreed to pay for completed work that the his insurance company did not cover.

John Beal claims it failed to receive the remaining balance of $6,454.19 for the materials purchased and labor expended.

The plaintiff alleges Williams failed and refuses to pay the amounts due upon the agreement together with interest at the rate of nine percent per annum since May 24.

The plaintiff requests a trial by jury and seeks to order the payment of $6,454.10 together with interest thereon at the rate of nine percent per annum from and after May 24, and for such other further relief as the court deems fair and equitable.

It is represented by Sheldon D. Korlin and Brett B. Caban of Aegis Professional Services in Clayton, Mo.
