Passenger alleges injuries from 2016 collision

BELLEVILLE — A passenger is suing a motorist for allegedly hitting the car he was riding in. 

Fred E. Cornwell filed a complaint on May 10 in St. Clair County Circuit Court against Amber N. Duboise, alleging she failed to exercise reasonable care in the operation of her vehicle.

According to the complaint, the plaintiff alleges that on Feb. 20, 2016, he was riding as a passenger in a motor vehicle driven by Tina Cobb, which was lawfully stopped at the intersection of Camp Jackson Road and Mississippi Avenue. While stopped, the vehicle was allegedly struck from behind by the defendant's vehicle. 

As a result, Cornwell suffered extensive injuries, disability and expenses for medical care. 

The plaintiff alleges Duboise failed to keep a proper lookout, failed to reduce speed or stop or swerve in order to avoid injury and failed to properly apply the brakes of the vehicle.

The plaintiff requests a trial by jury and seeks judgment in excess $50,000, plus costs of suit and for such other relief as the court deems just and proper.
