Suit claims woman at Memorial Hospital Belleville injured due to faulty elevator

BELLEVILLE — An elevator passenger is suing a Memorial Hospital Belleville, citing alleged negligence in failing to properly maintain an elevator on its property.

Wendy Dudley filed a complaint on April 21 in the St. Clair County Circuit Court against Memorial Hospital Belleville and Memorial Regional Health Services Inc, alleging that the defendant hospital failed in its duty to exercise the highest degree of care in equipping, maintaining and operating elevator so as to avoid injury to persons carried by it.

According to the complaint, the plaintiff alleges that, on April 26, 2015, she was lawfully in the building when she fell to the floor while exiting the elevator. As a result, Wilson claims she suffered physical injuries and incurred medical expenses. 

The plaintiff holds the hospital responsible because it allegedly failed to maintain the elevator and its appurtenances in proper and safe condition and failed to properly inspect the elevator for the carriage of passengers.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit and any other further relief the court deems just and proper. She is represented by Daniel G. Broombaugh of Caraway, Fisher and Broombaugh PC in Belleville.
