Roxana man says home was contaminated by nearby oil refineries

Oildrill 03

EDWARDSVILLE — A Roxana resident is suing several oil refinery operators for allegedly contaminating his home.

Eric Carter filed a complaint on May 16 in the Madison County Circuit Court against Shell Oil Company, Equilon Enterprises LLC, doing business as Shell Oil Products US, and BP Products North America Inc., alleging they breached their duty to use reasonable care to avoid causing injury to others.

According to the complaint, the plaintiff alleges the defendants failed to appropriately store and dispose of toxic materials, causing his residence to be contaminated with toxic petroleum byproducts and other chemicals.

As a result of defendants' negligence, Carter claims he suffered injuries because of his contact with toxic materials at his Roxana home near the defendants' oil refineries.

The plaintiff requests a trial by jury and seeks compensatory damages of not less than $50,000, costs of this suit and such other just and appropriate relief.

He is represented by Ted N. Gianaris and Jo Anna Pollock of Simmons Hanly Conroy in Alton.
