CarX auto repair shop chain failed to pay overtime wages, class action suit alleges

EAST ST. LOUIS — An automotive technician has filed a class action lawsuit against Brex Inc. d//b/a CarX, John Keeley and Kevin Floyd, repair shop operators, citing alleged violation of workers compensation acts for refusing to pay overtime.

Tom Reed, who worked at the Belleville CarX location, filed a complaint on behalf of all others similarly situated on March 20 in the U.S. District Court for the Southern District of Illinois claiming the defendants violated the Fair Labor Standards Act and the Illinois Minimum Wage Law. The defendants run a chain of CarX locations in Illinois and Missouri and employ dozens of technicians at any given time, according to the complaint.

According to the complaint, the plaintiff alleges that he was permitted to work in excess of 40 hours per work week without being properly compensated. The plaintiff holds the defendants responsible because they allegedly failed and refused to pay regular and overtime wages for work performed in excess of 40 hours per week and failed to record compensable work time.

The plaintiff requests a trial by jury and seeks compensatory damages, attorneys’ fees and costs, interest and such other relief as the court deems fair. He is represented by Mark Potashnick of Weinhaus & Potashnick in St. Louis and Jack R. Daugherty of Law Office of Jack Daugherty PC in Alton.
