BELLEVILLE — A Fairview Heights woman claims another driver caused a collision near St. Ellen Mine Road.
Danielle N. Schultz filed a complaint on Feb. 7, in the St. Clair County Circuit Court against Lebanon resident Michael A. Mueller, alleging he failed to operate his vehicle with adequate care on a public road.
According to the complaint, Schultz alleges she was traveling eastbound on W. Highway 50 on Feb. 15, 2015, at the intersection of St. Ellen Mine Road when she collided with the defendant's vehicle, which hit the front side of her vehicle.
As a result, Schultz claims she suffered physical injuries, disability and incurred medical expenses.
The plaintiff alleges Mueller failed to keep a proper lookout for other vehicles, failed to keep his vehicle under proper control, failed to properly apply brakes, failed to reduce or decrease his speed while approaching an intersection and failed to yield the right of way to oncoming traffic.
The plaintiff requests a trial by jury and seeks damages of more than $50,000 plus the costs of this suit and any other relief the court deems proper.
She is represented by Chet A. Kelly of Foley and Kelly, LLC in Belleville.
