Owners of Carbondale property alleged to have defaulted on mortgage

BENTON – The mortgage on a Jackson County property is allegedly in default.

The United States of America, through the Rural Housing Service or successor agency, the United States Department of Agriculture, filed a suit Feb. 16 against Shane Charles Hassler, the city of Carbondale and Capital One Bank (USA) N.A. in the U.S. District Court for the Southern District of Illinois, alleging failure to pay off a mortgage.

According to the suit, the plaintiff allowed the defendant to mortgage the property located at 405 N. Smith in Carbondale. The suit states that the defendant was required to make regular payments on the mortgage, but failed to do so and is now indebted to the plaintiff for a total balance of $128,291.09, which includes interest and fees.

The defendant is accused of failing to pay off the balance.

The plaintiff is seeking judgment for sale and foreclosure of the property, attorneys' fees and court costs.

The plaintiff is represented by Donald S. Boyce and Gerald M. Burke of the States Attorney's Office in Fairview Heights.
